This Privacy Policy explains how we collect, use, disclose, transfer, store and protect information when you use PushtoLearn websites, online educational services, browser-based games and mobile applications, including PushtoLearn Games (collectively, the "Service").

This Privacy Policy applies to the PushtoLearn website, PushtoLearn Games and other products and services operated by PushtoLearn.

Certain PushtoLearn educational platforms may be operated in cooperation with schools, educational organizations or other partners. In those situations, the relevant partner may act as the data controller and PushtoLearn may process personal data on that partner's behalf.

For services provided directly by PushtoLearn, including PushtoLearn Games, PushtoLearn determines how personal data is processed as described in this Privacy Policy.

1. Site Security and Data Protection Principles

Site Security: For site security purposes and to ensure that this service remains available to all users, the platform for which PushtoLearn.com resides on - commonly known as a "production environment," utilizes a wide-range of software tools and programs to for the ultimate goal of ensuring its confidentiality, integrity, and availability. Tools which are currently in use, or are to be deployed, if necessary, for the security of PushtoLearn.com are to include, but are not limited to, the following:

• Network Security and Network Monitoring: Tools that assist in securing the network for which PushtoLearn.com resides on. Such tools include network and perimeter firewalls, web application firewalls, routers, switches, intrusion detection systems, and other related tools.
• Network Performance: Tools that assist in monitoring all aspects of PushtoLearn.com, such as performance monitoring for website uptime, etc.
• Other: Additionally, a variety of physical, electronic, and procedural safeguards are implemented for helping ensure the safety and security of PushtoLearn.com.

Information Security: All information accessed through PushtoLearn.com is in compliance with the required information security mandates of Article 32 of the GDPR. Specifically, Article 32 mandates the following:

• Implement appropriate technical and organizational measures to ensure a level of security appropriate to the risk:

  • The ability to ensure the ongoing confidentiality, integrity, availability and resilience of processing systems and services.

2. Data We Collect

2.1 Summary

PushtoLearn SaaS Application: The PushtoLearn Application is a SaaS based Learning Management System which is hosted solely within Europe. PushtoLearn does not access or disclose personal information within the Application unless directed by the Client or in support of the Contract and agreement.

While using our Service, we may ask you to provide us with certain personally identifiable information that can be used to contact or identify you. Personally identifiable information may include, but is not limited to, your email address, name, phone number, and other information ("Personal Information").

We collect this information for the purpose of providing the Service, identifying and communicating with you, responding to your requests/inquiries, and improving the Service. For certain educational platforms operated in cooperation with schools, educational organizations or other partners, personal information may be processed on behalf of the relevant partner. Depending on the circumstances, the partner may act as the data controller and PushtoLearn may act as a data processor. For services provided directly by PushtoLearn, including PushtoLearn Games, PushtoLearn acts as the controller of personal information as described in this Privacy Policy.

You have a right to access your Personal Information and may request that any such data which is factually inaccurate, incomplete, outdated or irrelevant to the purpose(s) of the processing be corrected or deleted. If admissible by applicable data privacy laws, PushtoLearn may limit or deny access to your Personal Information where providing such access would be unreasonable.

2.2 Types of Personal Data We Collect

The types of personal data collected are listed as follows:

• Name (First Name, Last Name)
• Email Address
• Digital Identifiers, such as usernames
• Personal data required by various form fields, and/or for purposes of searching, retrieving, and downloading data from PushtoLearn.com.

Highly Sensitive Information: PushtoLearn does not collect sensitive personal information such as: personal information specifying medical or health conditions, racial or ethnic origin, political opinions, religious or philosophical beliefs, trade union membership, or sexual orientation, for any purpose.

2.3 PushtoLearn: Offline Games Mobile App

PushtoLearn operates the mobile application PushtoLearn: Offline Games for iOS and other supported mobile platforms.

The privacy practices of the mobile application differ from those of the PushtoLearn.com website.

Information Stored on Your Device

The PushtoLearn: Offline Games app stores certain information locally on your device in order to provide game functionality and remember your preferences.

This information may include:

• game statistics, such as games played, results, streaks, scores or other gameplay progress;

• selected game settings;

• sound preferences;

• selected language;

• difficulty, word length or other gameplay preferences.

This information is stored locally on your device and is used to provide features such as saved settings, gameplay statistics and progress tracking.

PushtoLearn does not currently transmit, receive or store this gameplay information on its servers.

Removing the application or clearing its locally stored data may permanently remove this information.

Personal Information

The PushtoLearn: Offline Games app does not currently require users to create an account or provide their name, email address, phone number or other personally identifiable information.

Analytics and Tracking

The current version of PushtoLearn: Offline Games does not use user data for advertising or cross-app tracking.

The app does not currently use gameplay statistics or locally stored preferences to track users across apps or websites owned by other companies.

If analytics or similar technologies are introduced in a future version, this Privacy Policy and the applicable App Store privacy disclosures will be updated accordingly.

Advertising

The current version of PushtoLearn: Offline Games does not display third-party advertising and does not use user information for advertising purposes.

Advertising may be introduced in future versions of the application. If this occurs, this Privacy Policy will be updated to describe the advertising providers used, the information they may process, and any choices or consent mechanisms available to users.

Offline Use

PushtoLearn: Offline Games is designed to provide its core games without requiring an internet connection. Gameplay progress and preferences described above can be stored locally on the device without being transmitted to PushtoLearn.

Future Features

Future versions of PushtoLearn: Offline Games may introduce additional features, such as new games, cloud synchronization, analytics, advertising or other online functionality.

If any future feature changes the way personal information or device information is collected, used, transmitted or shared, we will update this Privacy Policy and our App Store privacy disclosures before or when those features are introduced.

3. Information Sharing

We do not sell your personal information.

We may disclose personal information to service providers and technology partners where necessary to operate and improve the Service. These providers may include companies that provide hosting, analytics, advertising, attribution, crash reporting, diagnostics, payment processing, application distribution and customer support.

For certain educational platforms operated on behalf of schools, educational organizations or other partners, we may share information with the relevant partner as necessary to provide the Service.

We may also disclose information where required by applicable law, regulation, legal process, subpoena or court order, or where reasonably necessary to protect the rights, property, security or integrity of PushtoLearn, our users or others.

Where required by applicable law, personal information will be shared for advertising or similar purposes only after any required consent has been obtained.

4.Retention Period

We will keep your personal data only for as long as necessary to fulfill the purposes for which we are processing it unless the law permits or requires longer. For example, we might need to keep your personal data for quality assurance of the service we have provided, or we might need to keep it to defend future legal claims or to comply with a legal obligation.

How long we retain your data depends on the type of data and the purpose for which we process the data. We will retain your Personal Information for the period necessary to fulfill the purposes outlined in this Privacy Policy unless a longer retention period is required or permitted by law.

PushtoLearn integrates with several third-party applications, such as Zoom. For these third-party applications, PushtoLearn may retain certain data and access tokens to these applications until you unlink your third-party account from PushtoLearn. All data will be retained in accordance with this Privacy Policy.

5. Log and Technical Data

The information described in this section primarily relates to the PushtoLearn.com website and other online PushtoLearn services.

When you visit PushtoLearn.com, our servers and third-party service providers may process standard technical information such as IP address, browser type, operating system, pages visited, access times and similar log information.

These website practices should not be interpreted as applying automatically to the PushtoLearn: Offline Games mobile application.

For the current version of PushtoLearn: Offline Games, gameplay statistics, sound preferences, language preferences and other game settings are stored locally on the user's device and are not transmitted to PushtoLearn as part of the app's core functionality.

The current version of the mobile application does not collect precise location information or use device information for cross-app tracking or advertising.

6. Cookies

Cookies: When you visit some websites, their web servers generate pieces of information known as cookies. Cookies are commonly used to recognize your computer in the future. PushtoLearn.com uses session cookies for its legitimate interest of pursuing technical purposes, such as providing seamless navigation through our site, allow you to carry information across pages of our site and avoid having to re-enter information. PushtoLearn.com session cookies are available only during an active browser session. When you close your browser, the session cookie disappears.

PushtoLearn.com also uses persistent cookies for a number of legitimate interests, such as to be able to track the number of unique visitors to the site. Additionally, persistent cookies enable PushtoLearn to tailor content and related subject matter to match your preferred interests and/or for the purposes of not showing you the same content and related subject matter repeatedly. We may also employ cookies to compile anonymous, aggregated statistics that allow us to understand how users use our site and to help us improve the structure of our website. We use this information to understand how visitors use our website and to improve the Service. Please note that PushtoLearn does not gather, request, record, require, collect, or track any type of Internet users' personal data (as listed above) through these processes.

PushtoLearn.com may contain links to websites created and maintained by other public and/or private organizations. PushtoLearn.com therefore provides these links as a service to our users, and when users click on a link to an external website, they are leaving PushtoLearn.com and are thus subject to the privacy and security policies/related terms and conditions of these external websites.

We strongly advise you to review the Privacy Policy of every site you visit. We have no control over, and assume no responsibility for the content, privacy policies or practices of any third-party sites or services.

PushtoLearn recognizes the importance of protecting children's privacy.

Where a user is below the age at which they can legally consent to the processing of personal data in their country or region, consent from a parent or legal guardian may be required.

We do not knowingly collect personal information from children in circumstances where parental consent is required by applicable law unless the required consent has been obtained.

Where we know that a user must be treated as a child under applicable law or platform requirements, we will handle that user's information in accordance with the applicable requirements concerning children and minors.

Your continued use of the Service after we post any modifications to the Privacy Policy on this page will constitute your acknowledgment of the modifications and your consent to abide and be bound by the modified Privacy Policy.
