We operate this site in conjunction with our partners (language schools) who manage the day to day operation of their respective site (our “Partners”).

This Privacy Policy has been developed in accordance with the EU General Data Protection Regulation (GDPR).

We will not use or share your information with anyone except as described in this Privacy Policy. We use your Personal Information for providing and improving the Service. By using the Service, you agree to the collection and use of information in accordance with this policy. Unless otherwise defined in this Privacy Policy, terms used in this Privacy Policy have the same meanings as in our Terms of Service (accessible at Terms of Use).

Site Security: For site security purposes and to ensure that this service remains available to all users, the platform for which PushtoLearn.com resides on - commonly known as a "production environment," utilizes a wide-range of software tools and programs to for the ultimate goal of ensuring its confidentiality, integrity, and availability. Tools which are currently in use, or are to be deployed, if necessary, for the security of PushtoLearn.com are to include, but are not limited to, the following:

  • Network Security and Network Monitoring: Tools that assist in securing the network for which PushtoLearn.com resides on. Such tools include network and perimeter firewalls, web application firewalls, routers, switches, intrusion detection systems, and other related tools.
  • Network Performance: Tools that assist in monitoring all aspects of PushtoLearn.com, such as performance monitoring for website uptime, etc.
  • Other: Additionally, a variety of physical, electronic, and procedural safeguards are implemented for helping ensure the safety and security of PushtoLearn.com.

Information Security: All information accessed through PushtoLearn.com is in compliance with the required information security mandates of Article 32 of the GDPR. Specifically, Article 32 mandates the following:

  • Implement appropriate technical and organizational measures to ensure a level of security appropriate to the risk:

    • The ability to ensure the ongoing confidentiality, integrity, availability and resilience of processing systems and services.

2. Data We Collect
2.1 Summary

PushtoLearn SaaS Application: The PushtoLearn Application is a SaaS based Learning Management System which is hosted solely within Europe. PushtoLearn does not access or disclose personal information within the Application unless directed by the Client or in support of the Contract and agreement.

While using our Service, we may ask you to provide us with certain personally identifiable information that can be used to contact or identify you. Personally identifiable information may include, but is not limited to, your email address, name, phone number, and other information ("Personal Information").

We collect this information for the purpose of providing the Service, identifying and communicating with you, responding to your requests/inquiries, and improving the Service. Data collected on the PushtoLearn platform is on behalf of our Partners, and our Partners have ultimate ownership of data you provide on this Platform. If you do not agree to giving ownership of your data on the PushtoLearn platform to our Partner who is operating this site, please contact info@pushtolearn.com to delete your account and all associated data.

You have a right to access your Personal Information and may request that any such data which is factually inaccurate, incomplete, outdated or irrelevant to the purpose(s) of the processing be corrected or deleted. Requests to access your Personal Information or other questions related to the collection, use and security of your Personal Information can be addressed to PushtoLearn by contacting us via email to: info@pushtolearn.com, Attn: Privacy. If admissible by applicable data privacy laws, PushtoLearn may limit or deny access to your Personal Information where providing such access would be unreasonable.

2.2 Types of Personal Data We Collect

The types of personal data collected are listed as follows:

  • Name (First Name, Last Name)
  • Email Address
  • Digital Identifiers, such as usernames
  • Personal data required by various form fields, and/or for purposes of searching, retrieving, and downloading data from PushtoLearn.com.

Highly Sensitive Information: PushtoLearn does not collect sensitive personal information such as: personal information specifying medical or health conditions, racial or ethnic origin, political opinions, religious or philosophical beliefs, trade union membership, or sexual orientation, for any purpose.

3. Information sharing

We will not share your information with anyone except as described in this section and other sections of this Privacy Policy. Please read it carefully. PushtoLearn operaties online platforms on behalf of our Partners (language schools). When you sign up for a PushtoLearn powered platform, the Partner who has contracted with PushtoLearn to host the platform is explicitly clear. PushtoLearn will share your data with our Partner who has contracted with us to power the platform.

There may be other circumstances when PushtoLearn will share your data. PushtoLearn may share your data with regulatory and other governmental entities as required by applicable law, subpoena, or court order. PushtoLearn does not share your data with any third parties for marketing or data mining purposes.

4.Retention Period

We will keep your personal data only for as long as necessary to fulfill the purposes for which we are processing it unless the law permits or requires longer. For example, we might need to keep your personal data for quality assurance of the service we have provided, or we might need to keep it to defend future legal claims or to comply with a legal obligation.

How long we retain your data depends on the type of data and the purpose for which we process the data. We will retain your Personal Information for the period necessary to fulfill the purposes outlined in this Privacy Policy unless a longer retention period is required or permitted by law.

PushtoLearn integrates with several third-party applications, such as Zoom. For these third-party applications, PushtoLearn may retain certain data and access tokens to these applications until you unlink your third-party account from PushtoLearn. All data will be retained in accordance with this Privacy Policy.

5. Log data

We may use and store information about your location depending on the permissions you have set on your device. We use this information to provide features of our Service, to improve and customize our Service.We collect information that your browser sends whenever you visit our Service ("Log Data"). This Log Data may include information such as your computer's Internet Protocol ("IP") address, browser type, browser version, the pages of our Service that you visit, the time and date of your visit, the time spent on those pages and other statistics. In addition, we may use third-party services such as Google Analytics that collect, monitor and analyze this type of information in order to increase our Service's functionality. These third-party service providers have their own privacy policies addressing how they use such information. When you access the Service by or through a mobile device, we may collect certain information automatically, including, but not limited to, the type of mobile device you use, your mobile device’s unique device ID, the IP address of your mobile device, your mobile operating system, the type of mobile Internet browser you use, your location information and other statistics. You can enable or disable location services when you use our Service at anytime, through your mobile device settings.

PushtoLearn.com uses session cookies for its legitimate interest of pursuing technical purposes, such as providing seamless navigation through our site, allow you to carry information across pages of our site and avoid having to re-enter information. PushtoLearn.com session cookies are available only during an active browser session. When you close your browser, the session cookie disappears.

PushtoLearn.com also uses persistent cookies for a number of legitimate interests, such as to be able to track the number of unique visitors to the site. Additionally, persistent cookies enable PushtoLearn to tailor content and related subject matter to match your preferred interests and/or for the purposes of not showing you the same content and related subject matter repeatedly. Please note that PushtoLearn does not gather, request, record, require, collect, or track any type of Internet users' personal data (as listed above) through these processes.

If you are an EU resident and PushtoLearn is processing, and/or transmitting your personal data, then you - as an "EU data subject" - benefit from the following rights and privileges under the General Data Protection Regulation (GDPR):

Right to Data Portability: where your personal data have been provided on the basis of your consent or for the performance of a contract, and their processing occurs in an automated way, you have the right to receive the personal data you have provided to us in a structured, commonly used and machine-readable format and have the right to transmit those data - or have directly transmitted - to another controller.

Right to Object: you have the right to object, on grounds relating to your particular situation, at any time to processing of your personal data based on a legitimate ground point (e) or (f) of Article 6(1), including profiling based on those provisions. In this case, we can no longer process your personal data unless we show that there is a compelling legitimate ground for the processing which override your interests, rights, and freedoms or for our establishment, exercise, or defense of legal claims.

8. Third Party Disclosures

PushtoLearn as a Processor: As a standard practice PushtoLearn does not disclose personal information to any third party or unauthorized party for any reason. Should PushtoLearn be required to disclose any personal data to third parties, it will not do so unless fully authorized by the client agreement or in accordance with support of the agreement, or applicable law.

PushtoLearn as a Controller: PushtoLearn direct methods of personal data collection include through our website, marketing, sales outreach, and third party provided information. This information is used solely to contact individuals and or organizations about sales, adverting or marketing prospects of PushtoLearn products. Any discloser of personal information to a third party is relegated to only be used on behalf of PushtoLearn and at PushtoLearn' direction, and not for any other purpose.

9. External Links

PushtoLearn.com may contain links to websites created and maintained by other public and/or private organizations. PushtoLearn.com therefore provides these links as a service to our users, and when users click on a link to an external website, they are leaving PushtoLearn.com and are thus subject to the privacy and security policies/related terms and conditions of these external websites.

We strongly advise you to review the Privacy Policy of every site you visit. We have no control over, and assume no responsibility for the content, privacy policies or practices of any third-party sites or services.

10. Children's Privacy

PushtoLearn.com complies with GDPR. While children under the age of eighteen (18) may use the Site only with the consent of his or her parent or legal guardian, please be advised that this Site is not directed or otherwise promoted for use by children under the age of sixteen (16). By using the Service, you represent that you are at least sixteen (16) years of age. If you are between sixteen (16) and eighteen (18) years of age, you will need to have parental consent to use the Service. If you are below sixteen years of age, you should stop using the Site and Service immediately. Personal data from children under 16 is not knowingly collected, nor are children under 16 knowingly contacted by PushtoLearn.com. To be clear, PushtoLearn.com does not intend to solicit information of any kind from children under 16. It is possible that PushtoLearn.com may receive emails pertaining to children under 16. If this is the case and PushtoLearn.com is notified of this, as soon as the information is verified, parental consent will be immediately obtained, or the email will be deleted from any services being offered and/or performed by PushtoLearn.com.

We will make reasonable efforts to verify in such cases, where appropriate, that consent is given or authorized by the holder of parental responsibility over the child, taking into consideration available technology.

This Privacy Policy is effective as of January 4, 2023 and will remain in effect except with respect to any changes in its provisions in the future, which will be in effect immediately after being posted on this page.
